# Raid - Possession of Government Issued Equipment/Items

Timeline for Enactment: Effective immediately (On release)

When an individual(s) has been found in possession of Government issued items/equipment. The Police Department may raid the individual(s) properties if they have been found in possession of the following;

#### RAID TRIGGERS - INSTANT

Possession of ANY of the following = Immediate Raid Justified (Full search of property, vehicle, or storage permitted without DOJ approval)

* PD Glock
* PD Combat Shotgun
* PD HK416 Rifle
* PD Smoke Launcher

**Even one of these items justifies a full raid.**

#### RAID TRIGGER — STACKED EQUIPMENT CHARGES

If a suspect possesses 5 or more stackable Government-Issued Equipment Charges (see list below), a raid is also justified. This applies even without possession of an instant-raid item.

GOVERNMENT-ISSUED EQUIPMENT CHARGES (MAX 5 COUNTS)

These items result in stackable charges. Each qualifying quantity = 1 charge, up to 5 charges. If a suspect reaches 5 charges or more, a raid is justified.

| Item                             | Quantity per Charge |
| -------------------------------- | ------------------- |
| PD Armor                         | 1 per 1             |
| PD Slimjims                      | 1 per 1             |
| PD Spike Strips                  | 1 per 3             |
| PD Dufflebags                    | 1 per 5             |
| PD iFak                          | 1 per 5             |
| PD Flashlights                   | 1 per 5             |
| PD Evidence Bags (Empty)         | 1 per 20            |
| PD Evidence Bags (with Evidence) | 1 per 1             |
| PD Taser                         | 1 per 1             |
| PD Smoke Launcher Cartridge      | 1 per 1             |
| PD Portable Raft                 | 1 per 1             |

Charges can be applied at arrest. If the suspect has 5 or more, officers are permitted to initiate a property raid.

EXAMPLES

Example 1: Suspect has:

* 3x PD Slimjims
* 1x PD Taser
* 10x iFax = 10 Government-Issued Equipment Charges → Raid Justified

Example 2: Suspect has:

* 1x PD Combat Shotgun = Instant Raid Justified + 1 Firearm Charge

#### **PROBABLE CAUSE FOR ADDITIONAL WARRANTS**

If officers have probable cause to believe additional contraband, weapons, or evidence of crime is present, they may seek an additional warrant. Examples of probable cause include:

* Nature of seized PD equipment
* Visual confirmation by Government Employees
* Known criminal affiliations or prior arrests

#### SEARCH WARRANT PROTOCOL

* No DOJ approval required for raids triggered by:
* Instant-Raid Items
* 5 or more PD Equipment Charges
* DOJ approval required if unrelated illegal items (e.g., drugs, civilian firearms) are found and not covered under initial justification.

#### LEGAL CONSEQUENCES

* Charges are stackable per item category maximum stackable of 10.
* Possession of 5 or more qualifying items = raid + charges.
* Possession of instant-raid items = automatic raid + charges

**For example: If a Government Employee sees the individual in a Possession of Government Issued Items/Equipment they can assume due to the nature of how to obtain that equipment more could be stashed away in their properties.**

Search Warrant

* Law enforcement does not need to seek DOJ approval of a search warrant for a raid for PD Equipment, however if additional illegal items are found during the raid officers must request another search warrant for those items.
* If officers conduct a raid legally and find further Government Issued Items/Equipment, the individual(s) will be charged according to the penal code and Stackable per individual Item.

Legal Consequences:

* Being found in possession of Government Issued Items/Equipment can lead to serious legal consequences, including arrest, charges, and the possibility of further investigation, such as a raid, depending on the context of the situation.

Therefore, Possession of Government Issued Items/Equipment can indeed be a significant factor that justifies a house raid, especially if there are other factors that support the need for a search.

If you require assistance or clarification, contact PD Command or the Department of Justice.

Implementation: Effective immediately.

## Querying This Documentation
If you need additional information that is not directly available in this page, you can query the documentation by asking a question.

Perform an HTTP GET request on the following URL with the `ask` and `goal` query parameters:

```
GET https://doj.secondliferp.com/legislation/doj-legislation/department-of-justice-public-legislation/search-and-seizure-warrant-requirement-and-procedures/raid-possession-of-government-issued-equipment-items.md?ask=<question>&goal=<user_goal>
```

`ask` is the immediate question: it should be specific, self-contained, and written in natural language.
`goal` is what the user is ultimately trying to achieve, the reason they need the answer. Sharing it helps GitBook give you a better, more relevant answer. A goal is most helpful when it describes the outcome the user wants rather than restating the question. For example, with `ask=how do I create an API token`, a goal like `automate deployments from our CI pipeline` lets GitBook tailor the answer to that use case.

The response will contain a direct answer to the question and relevant excerpts and sources from the documentation.

Use this mechanism when the answer is not explicitly present in the current page, you need clarification or additional context, or you want to retrieve related documentation sections.
